1. Agreement

This website is operated by Blue Fairy Digital, Inc. ("Blue Fairy Digital", "we", "us"). By using it you agree to these terms. If you do not agree with them, please stop using the site.

Our applications, when released, will be governed by their own terms presented at the point of download or account creation. Nothing here replaces those.

2. What this site is

This website is informational. It describes who we are and how to reach us. Nothing on it is an offer to sell, a commitment to build any particular thing, a promise of availability on any date, or professional, legal, or financial advice. Forward-looking statements about what we intend to build are exactly that, and we may change our plans without notice.

3. Intellectual property

The content of this site — text, layout, code, imagery, and the Blue Fairy Digital name, logo, and wordmark — belongs to Blue Fairy Digital, Inc. or its licensors and is protected by copyright and trade mark law.

You may view and print pages for your own personal, non-commercial use, and quote short extracts with attribution and a link. You may not otherwise copy, republish, or use our branding without written permission. Journalists should write to press@bluefairydigital.com for approved assets.

4. Acceptable use

You agree not to:

• use the site unlawfully, or to facilitate anything unlawful;
• attempt to gain unauthorised access to the site, its hosting, or any connected system;
• interfere with the site's operation or availability, including by automated request flooding;
• introduce malicious code; or
• scrape or harvest the site in a manner that burdens its operation, or use its contents to train a machine-learning model without our written permission.

Good-faith security research is welcome. Please report findings to security@bluefairydigital.com and give us a reasonable opportunity to fix an issue before disclosing it. We will not pursue researchers who act in good faith and avoid privacy violations, data destruction, and service disruption.

5. Availability and accuracy

We aim to keep this site accurate and available, but we do not guarantee either. Content may become out of date, and we may change, suspend, or withdraw any part of the site at any time without notice.

6. Third-party links

Where we link to another organisation's site, we do so for convenience. We do not control those sites and are not responsible for their content, practices, or privacy policies.

7. Disclaimer and limitation of liability

This site is provided "as is" and "as available", without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, Blue Fairy Digital will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of your use of or inability to use this site. Our total aggregate liability arising from your use of this site will not exceed one hundred United States dollars (US$100).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

8. Indemnity

You agree to indemnify Blue Fairy Digital against claims, losses, and reasonable legal costs arising from your breach of these terms or your misuse of this site.

9. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts and the federal laws of the United States, without regard to conflict-of-law rules. The state and federal courts located in Suffolk County, Massachusetts will have exclusive jurisdiction, and you consent to that jurisdiction and venue. Nothing here deprives a consumer of the protection of mandatory law in their country of residence.

10. Changes

We may revise these terms. The version in force is the one published here, with the date at the top. Continued use of the site after a change means you accept the revised terms.

11. General

If any provision of these terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These terms are the entire agreement between us regarding this website.
